DMCA & Copyright Policy

Propal respects intellectual property rights and expects its users to do the same. We respond to clear, valid notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512), the EU Copyright Directive (2019/790) and equivalent national laws. This page explains how to send us a takedown notice, how to counter one, and what to expect from our process.

1. Designated Copyright Agent

2. Before you file a notice

Please consider whether the use of your work qualifies as fair use, fair dealing, parody, criticism, or another legal exception. Filing a knowingly false notice can expose you to liability under 17 U.S.C. § 512(f).

3. Filing a takedown notice

To be effective, your notice must be in writing and include all of the following:

  • A physical or electronic signature of the copyright owner or authorized agent.
  • Identification of the copyrighted work claimed to be infringed (or a representative list, if multiple works at a single site).
  • Identification of the allegedly infringing material with enough detail for us to locate it — ideally the full Propal URL.
  • Your contact information: full legal name, postal address, telephone number and email.
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.

Incomplete notices may delay or prevent action. We typically respond to valid notices within 5 business days.

4. Counter-notice procedure

If your content was removed and you believe the removal was a mistake or misidentification, you may submit a counter-notice. Your counter-notice must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed and the URL where it previously appeared.
  • A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
  • Your name, address, telephone number and email.
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you're outside the U.S., any judicial district in which Propal may be found) and that you will accept service of process from the original complainant.

If we receive a valid counter-notice, we may restore the content after 10–14 business days unless the original complainant notifies us that they've filed a court action.

5. Repeat-infringer policy

Propal terminates, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. We also reserve the right to terminate accounts for a single egregious infringement.

6. Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or was removed by mistake, may be liable for damages including costs and attorneys' fees.

7. Trademark, publicity and other complaints

For trademark complaints, right-of-publicity claims, or other non-copyright IP issues, use the same email address and we'll route your request to the right team.

8. Privacy of notices

We may forward complete copies of notices and counter-notices (including your contact information) to the affected user and to services like the Lumen Database. Don't include information you don't want made public.
